Sounds to me like this woman was trying to milk that Lemon for a bit more than it was worth.. she ended up with $61,000 for a sub $30k vehicle!

Every law in the books is abused by someone, but they do help the majority of people from getting screwed by the big companies.

She wasn't trying to screw anyone. Here in WI you are entitled to double damages in any civil suit, in this case: She surrendered the car and got $60,900, double what she paid, plus the finance charge. This seems a bit unfair since she did have what seems to have been a functional car for the full time. Mazda should get some credit for that.

What they don't get into too much is that the dealer and Mazda were playing word games. Somewhere along the line she wrote a letter to invoke the Lemon Law. Mazda claimed the letter did not include the correct legal terminology so they didn't know what she wanted. Glad it worked out for her, it would really suck for the rest of us if we had to go to an attorney just to start the Lemon Law claims process.

Anyway, the point is that even if we are in the right we may have to fight long and hard for what we're entitled too. We've had people post here with various problems and sometimes they just fold rather than fight for whats right. Maybe this will encourage some of them to fight for what they are entitled to. The pain inflicted on dealerships/manufacturers may also force them to stand up and do the right thing right away.

Good grief. Maybe she was ticked because they offered a warranty when she tried to envoke the whole lemon law thing. I would be ticked too.
Too bad either side coiuln;t get their act together and agree before it wasted everyone;s time and money.

A friend used the argument that he bought his Tribute, instead of the Escape from which it is rebadged, becuase of superior Mazda service...

Maybe he doesn't know Mazda is a division of Ford now, which is why they dont hold their resale value as well as Honda, Toyota, or Nissan.

While that may be true, Jaguar is also a div of Ford Motor Company. Ever price a certified used Jag? :shock:
