I am conducting this poll to find out if the members of LOST would take Jeep to court or not... I am happy other then worrying whether or not the Lower Ball Joint is going to loose a wheel doing 70mph while driving down the interstate..

I'm just going to replace my LBJs with Moogs............but lets set the record straight, if I had a LBJ failure while my family was embarked; I would file "The Mother of All Lawsuits!"

Obviously, after 4 or so years, Jeep IS NOT handling the problem. They are doing the absolute minimum they have to do (shields). They know the problem is there yet they are still denying warranty claims and putting it off on "abuse" or "modified vehicles". It's so bad that there have been reported injury cases and the NHTSA has upgraded the investigation into an "Engineering evaluation". This shows customer loyalty on Jeep's part how?

You can't tell me that fixing the problem would not be cheaper than settling a lawsuit or two. I think a class action suit or even threat of one would spur them into fixing these things properly. How many of you out there who don't want to sue are 100% confident that your LBJs WILL NOT fail while you are driving, maybe with your kids and/or wife in the car? I'm not! And if you are, I got a bridge for sale! :wink:

Mine were so bad that when I took it in to the dlr for an oil change he refused to let me leave with the KJ w/o replacing them even though I told him I would bring it back the next day! He insisted it was a safety issue and he didn't want to be liable if I crashed on the way home and back. I lost a day of work because of it. Better that than crashing. There was also a red KJ in the parking lot with a damaged rim, peeled off tire and jackstand under the suspension with a LBJ failure. 2 days earlier I had gone on a weekend trip to PA with my girlfriend and I felt shuddering when I braked. Attributed it to a warped rotor. I was doing 70-75 the whole trip. Could have been a disaster. Not sue? Please!!

I suggest that anyone who has had problems with these start compiling all their notes, invoices, paperwork, etc and we start getting this stuff together to present to a lawyer. I'll bet there are lawyers out there who would be happy to jump on this. We may even have some that are LOST members.

We are going to move this and the other ball joint post to the poll section. Please note that we have been telling EVERYONE to check your balljoints and report them no matter who replaced them of if they failed or not. If you own a KJ and the balljoints are loose...then they are BAD because the KJ is way too new for this to happen. We have made all kinds of links to report this and folks are still not doing it. Please do so anything you have a ball joint problem. Thanks. Later...Clint

Hey Sk, With the importance of this issue would it be possible to leave this in the General section? I know it's a poll but I think alot of people who hit the General section don't visit the polls section. Just a thought.

And for those of you who aren't worried because you check yours regularly, think of it this way: When it comes time to sell your KJ are you going to tell the potential buyer about the LBJ problem and possibly lose the sale? If you don't and later hear that they disintegrated and someone got hurt or worse, how will you feel? :cry:

So at the very least Jeep is potentially destroying YOUR resale value with this issue. I say, sue the pants off 'em!!

I personally wouldn't sue them because my KJ is lifted. How can I hold DC liable when I know for a fact that the ball joints are to the extremes as a result of my modifications. That's why Al made his upper A-Arms, because all of us who have lifted our KJs have brought them out of spec. However, if you're unlifted and have the problem multiple times I absolutely agree that some sort of action should be taken. Now my question is, would any other type of maintenance free joint last longer with our lifts, I really don't know.

Ah! But you forget, Dealers are lifting them and selling them. I also was told that as long as you don't go more than 3", the warranty is still good.

Again, it would be very important to know the number of LBJ's failing on stock KJ's compared to lifted KJ's.

As there are some dlrs who seem to be willing to replace the LBJs for life since there was a recall, maybe we should come up with a list of those LBJ replacement friendly dlrs to steer members to?

Just got back from my dlr. There was yet another!! KJ sitting there on a broken LBJ. We gotta sue man! :twisted:

I really hate how litigious our society has become, however, this is one of those times when I think a suit is justified. Even though DCX (at least some dealers) replaces them when they fail, what about the one time it lets go and some one gets killed? They really need to be more proactive here, and it looks like law suit may be the only way to force their hand.

The bold piece: you brought up an interesting point. If you know about that defect and sell it to someone without telling them, can they come back on you for not letting them know? You with held a life threatening condition from them.

I haven't had any issues with my LBJs but had them replaced under the recall over a year ago just because I could. However, I do realize there is an issue that neither the gov't nor DCX have corrected. I also understand that the lawsuit would not end up being against the people that designed the problem (DCX vs Cerberus), but against those that aren't correcting it. If the problem isn't being fixed then we need to take action. I don't care if the lawyers get the money, that's not what I would be after anyways, I want the problem fixed.

I have been wondering if the lower ball joint problems have certian years that had a problem? I know mine was not under the recall, so I am curious.

they replace them with the same part so there is a chance that it will break again, but so is there with the moogs, I took mine in when I bought it under recall and havent had a problem with them even before I took it in it was fine and mines an '02

A 12 year old balljoint failing is considered "already"?? How many miles?

There still should be an open recall on them, call your local dealer with the VIN to see if yours still qualifies. If not, get them replaced by some good quality MOOG replacements
