I think if your intake generated enough of a pressure gradient to draw fluid out of your diff, you'd have other issues
If, however, you were to run the vent tubes all the way up the inside of the snorkle then your fears would be alleviated. Seriously, though, what are you going to be fording in the electronically controlled KJ that will be THAT deep? Taking it to the top of the engine bay gives you nearly the same benefit unless you are completely submerged.
