Usually, when I first get on the highway my tranny wont shift into 5th gear for a few miles, any ideas what is happening?

If you get to a highway before normal operating temp is reached, the torque converter will not lock up. You may be interpreting this as it not shifting into top gear.

Cold start? Mine does this as well, it is part of the warm up of the engine and tranny. I keep below 100kph before I start getting on it.

Yeah - but the poor guy is stuck in Vail for the entire winter and has to drive a whole mile to get to work.
(he could probably ski to work)
so I bet he's not overheating it

not that I'd be Jealous or anything..

My CRD stays in the garage, it always shifts to OD at the first opportunity. I knew about how this works but have not noticed it in normal driving.

That is normal, you have had that thing long enough I am shocked that you have never noticed.
