You may have a law suit. The heater assembly is known for leakage. Never heard of a fire before though. Kind of hard to get diesel to ignite.

Chicago is full of Blood Sucker Lawyers (even though some became politicians), perhaps one could do something worth while and get you a settlement from Chrysler.

At best you MAY get a settlement, but it will be from the bankrupt part of Chrysler.

Remember dust up about Fiat not having ANY liability for ANY Chrysler products sold before emerging from bankruptcy (that includes our wonderful CRD).

The new company is only required to honor warranty service and recalls.

FYI, The new GM was forced by the bankruptcy court - or agreed to accept - product liability for pre bankruptcy sales.

Then again with Lawyers, who knows what angle/loophole they can dig up.

There have been mention of others on here. I can recall two, but I don't recall who they were.

Unfortunately, the reality is that the statute of limitations isn't your problem. It is that bankruptcy judge that gave Chrysler-Fiat all the gold and jewels from Daimler-Chrysler... And told everyone else that they would be left holding the bag.

He issued a decree that said that anyone with a claim (lawsuit, or potential in your case) against Daimler-Chrysler Would have no claim against Chrysler-Fiat. Chrysler-Fiat was a completely new and separate entity that had zero liability to any of the debts of the previous company.

It is NOT legally required of Chrysler-Fiat to pick up any of the warranty claims, even for the people with the so-called "lifetime" warranty on their vehicles. That "lifetime" was issued by Daimler-Chrysler, a now dead corporate entity. The ONLY reason that Chrysler-Fiat picked up any of the warranties (and it could EASILY be called a case-by-case basis) is for good publicity. Can you imagine the hue and cry that would have happened if they had said outright "We don't have any liability, and that includes your warranties. Have a nice day" to the public?

Instead, they publicly can say "we love our former customers" to the media... Then to the individual "bugger off, that problem isn't covered" and still reach the same end result: They get all the gold, we get the sack. Caveat Emptor, or to paraphrase a NY Italian accent "Is not personal, is business."

The reality in this situation is, the lawyers are right - It will cost more than the car is worth b/c no lawyer will take this on contingency. The likelihood of ANY recovery from a dead company is zilch, and Fiat got a free pass from that judge.

I think one of the conditions of the government sponsored bankruptcy was that the companies had to honor existing warranties. During the time between declaring and the actual reorganization taking place, the government covered the cost. Of course they could have weaseled out of this by now, but my understanding was that warranty obligations were transferred to the entity.
