Lawyers in Volkswagen Case Steer Toward Bosch

Lawyers seeking compensation for owners of cars affected by Volkswagen AG VLKAY -0.41 % ’s emissions-cheating scandal are turning up the pressure on auto-parts supplier Robert Bosch GmbH, and they are getting assistance from an unexpected corner: Volkswagen.

Attorneys representing hundreds of thousands of Volkswagen car owners in the U.S. filed a 742-page brief in San Francisco federal court this week that relies heavily on documents provided by Volkswagen to support allegations that Bosch, which supplied the engine control unit used in its diesel vehicles, worked “hand-in-glove” with the German car maker.

The allegations against Bosch aren’t new but have acquired greater urgency in the wake of the $15 billion settlement on behalf of U.S. Volkswagen customers and U.S. authorities. Bosch wasn’t a party to that settlement and still faces civil litigation.

Bosch supplied the engine control unit, which Volkswagen programmed to recognize when its diesel vehicles were undergoing emissions tests. The Stuttgart-based company has said that it isn’t responsible for how its components are integrated into vehicles by customers.

But the lawsuit claims Bosch didn’t allow manufacturers to make changes without its consent, saying it was “inconceivable, then, that Bosch did not know that the software it was responsible for defining, developing, testing, maintaining and delivering contained an illegal defeat device.”

Allegations that Bosch was aware of the rigging first emerged immediately after U.S. authorities disclosed that Volkswagen had rigged diesel engines to cheat on emissions tests. The auto maker later admitted to installing the cheating software on nearly 11 million vehicles world-wide.

The plaintiffs’ attorneys argue that the Clean Air Act not only forbids the use of defeat devices but also forbids the sale of components used as defeat devices if the seller is aware that the component will be used as such.

In papers filed by Leiff Cabraser Heimann & Bernstein LLP, the attorneys wrote their case is “based almost entirely on information produced by Volkswagen,” publicly available documents, and their own research. Bosch has provided few documents, “none of which merit consideration,” they said.

The updated complaint cites an email dated May 31, 2013, from a U.S.-based Volkswagen employee concerning 2-liter diesel vehicles that refers to a “proposed strategy” to “get the executive order (from CARB) based on the ‘Bosch’ strategy.” CARB is the California Air Resources Board, a state environmental regulator.

A Bosch spokesman said in an emailed statement that the company was “cooperating with the investigations in various jurisdictions, and is defending its interests in the litigation. As a matter of policy, and due to the sensitive legal nature of these matters, Bosch will not comment further concerning matters under investigation and in litigation.”

The plaintiffs’ lawyers are now pressing Bosch to provide information “but the evidence already proves that Bosch played a critical role in [the] scheme to evade U.S. emission requirements,” they said in the Aug. 16 court filing. Bosch’s actions, they said, “demonstrate that Bosch was a knowing and active participant in the decade-long illegal enterprise to defraud U.S. consumers.”

Bosch’s electronic diesel control unit, called the EDC Unit 17, contains specific algorithms to adjust fuel levels, air pressure, recirculation of exhaust gas to lower NOx emissions, and injection rates of urea, the fluid used to break down NOx into harmless component parts before it is emitted from a car’s tail pipe. EDC Unit 17 also is used on diesel vehicles from several manufacturers, including Volkswagen, BMW AG BMW -0.48 % and Daimler AG DDAIY -0.34 % ’s Mercedes-Benz.

A study conducted by the German government concluded earlier this year that most manufacturers were using software to manipulate toxic emissions from the diesel vehicles, although Volkswagen appeared to be the only one to install test recognition software.

All of this makes me hesitant to bother buying another modern diesel. Not because I don't like driving one or that I have an issue with emissions, but because it's just not worth it. VW got caught with their pants down, Jeep slapped together these jeeps, it seems the ecodiesel rams are blowing up at an alarming rate if you go by that forum. . . . Maybe Ford will do something right on the F150 diesel.

Plus at this point GTDI almost negates any low end performance benefits of diesel. Really all you have is better gas mileage, and with today's gas prices, even that's negligible unless you drive insane miles. Reliability hasn't exactly been great on some of the newer US diesels we've seen so don't claim that.

VW Scandal Won’t Kill Diesels

There is a famous old Monty Python skit where a disgruntled customer walks into a pet shop with a bird cage and wants to return an obviously dead parrot. The proprietor insists the parrot is “just resting” and the ensuing argument takes silliness to a comedic level that may never be equaled.

Thanks to the horrible news revolving around Volkswagen’s emissions cheating scandal, it’s easy to picture diesel proponents as the man behind the pet shop counter insisting diesel powerplants still have a future.

On the surface, the outlook for diesels appears grim. Diesel market share in U.S. light vehicles has fallen from 3.08% in 2014 to 2.29% through August 2016.

Until the scandal broke Sept. 18, 2015, VW traditionally sold more passenger-car diesels in the U.S. than any other automaker. In 2016, it is paying out tens of billions of dollars in fines and penalties for equipping millions of vehicles worldwide with emissions-cheating software.

VW also looks like it is walking away from compression-ignition engines by promising to spend billions developing an impressive lineup of electric vehicles and fund the expansion of EV charging networks.

What’s more, the VW scandal gives federal regulators and the powerful California Air Resources Board another reason to dislike the engines. They have never been fond of them to begin with, and now they have even less incentive to encourage consumers to buy them.

Just how much VW’s flagrant violation of emissions rules are to blame for the falling popularity of diesels currently is being studied by a variety of experts, but buyer outrage likely is far less the culprit than it seems at the moment.

The car-buying public has a very short memory when it comes to most issues. General Motors allegedly poisoned the U.S. diesel market in the early 1980s with a poorly executed diesel engine, but this appears to be a factoid only remembered by aging automotive journalists.

What is significant is that VW and its various brands are not allowed to sell diesels at all, and low gas prices are crimping interest in almost all high-efficiency powertrains. The only alternative powertrain to see an uptick in market share from 2014 to mid-2016, according to WardsAuto data, is plug-in hybrids. This surge is suspected to be driven by the fact they still qualify for generous incentives and access to California’s high-occupancy traffic lanes while conventional hybrids do not.

VW sold 37,397 diesel-powered Jettas in 2014 and 16,177 in 2015. Overall, the automaker sold 79,443 diesel-powered vehicles in the U.S. in 2014 and 54,197 in 2015.

Meanwhile, thanks to attractive new applications, some automakers actually saw diesel sales rise while VW was roiling the waters. For instance, Fiat Chrysler saw light-vehicle diesel sales rise from 65,602 during the first half of 2015 to 76,084 during the second half of the year when Dieselgate outrage was running high, thanks to the popularity of the 3.0L V-6 Turbodiesel in the Ram pickup. A spokesman says the take-rate continues to run from 10% to 15%.

GM also saw diesel vehicle sales rise during the crucial period following the VW revelations, and it recently announced it is doubling down on its commitment by offering diesel options in its new Chevy Cruze hatchback and Equinox CUV.

“Based on what we hear from manufacturers, what we have seen in our own opinion surveys and additional analysis, we are confident about the future role of clean diesel in the U.S. market despite the VW diesel emissions situation that has played out over the last year,” says Allen Schaeffer, executive director of the Diesel Technology Forum.

Clearly diesels are not for everyone, but when it comes to hauling loads, long-range fuel economy or pure stump-pulling torque, nothing can match them.

Even though cheap gas and bad publicity might be suppressing demand, it’s very possible diesel sales will perk up in the coming year. You can say diesel sales are taking a little rest and you can say it with a straight face.

Talk about burying the lead... Chrysler says they have sold 76,000 diesels in 2015, VW sold 79,443 diesel-powered vehicles in the U.S. in 2014 and 54,197 in 2015.

How many of those 76,000 Chryslers were the new VM 3.0 in the ram? Only 15,000-18,000 of the CRD were ever sold in TWO years in the USA, and they have more than quadrupled that number in just ONE year? THAT is a demand hit!
