Let me just point out that you have someone who has verbally agreed to pay you money owed, albeit with an unknown timeline. From your perspective you have no guarantees that you will ever see that money again with only someones word.

My thoughts:

Saying you are going to court to file in small claims serves no purpose here. Its essentially a threat that you are going to escalate things if you are not repaid in due time(due time having already passed from your perspective).

By forcing the issue to court you potentially lose out on the verbal agreed repayment. The party could decide to take their chances in court and delay payment until moderated there. Sure you might be able to garnish some wages out of a court ruling - but thats a bigger longer fight. Once someone has wages garnished do you think they will opt to pony up the money right away?

My conclusion: Don't announce to the world that you are going to take someone to court as a form of saber rattling. This only works if you think the person is bluffing(bluffing about being able to repay you in this case). You cannot squeeze blood from a stone, and saying you are does no one any good.

If Geordi doesn't have the assets to cover this the Judge will likely look at his income and order some sort of repayment schedule that he can realistically manage. You may or may not get awarded costs.

Given you both appear to agree that Geordi owes you money I'm not quite sure why you can't figure out a repayment schedule between yourselves rather that involving the courts?

I just went through this myself against my mother,25% of what she makes and her entire tax returns are mine till her bill to me is paid off and most likely will will never be paid off because of the amount owed but I will get some of it back.

You can always go the legal way if the other way fails as long as you don't exceed the statute of limitations. I've known people that don't care about going to jail so that can be a gamble too. One thing for sure though, the more you pish the person off the less likely it is to be resolved amicably.

If you care about your relationships suing your mother is never going to end well.

I certainly could not afford to be owed $2000.

Not everyone is in the position to just walk into a bank and get a loan. And I would guess the type of person that would have trouble paying back money might also be the person having trouble getting a loan.

Don't take the above to mean that I am takes sides with any party. I just want to point out that you cannot squeeze blood from a stone.

Anyone who runs a business needs to have cash flow. This is to compensate for ebbs and flows in the business and to have cash on hand to cover emergencies. If you had employees and tried to tell them you would pay them when you get some money, most would walk out.

It should never be the customers responsibility to become a lending institution. This also goes both ways as the business should expect payment in a timely manner from the customer for services rendered.

We all learn from our mistakes, Good and / or Bad! I can fully relate; been stiffed by a person in the past whom I thought at the time was a good friend; I helped him out of a bind and he never fully repaid me; wrote if off years ago and chalked it up to experience! :o
But have not forgotten the life lesson!!!
