 Post subject: BuyBack or Lemon it??

Whats the best way to go about either a buy back or a lemoning?
My stack of Repair Orders is about 20 pages long and this newest recall just erks me in a bad way. The crd is mainly for the wife and 2 kids and I hate to have her drive a vehicle that is constanly in the shop.

So far the crds been through:
1 cac
2 egrs
1 egr mix valve
2 glow plugs
1 glow plug sensor
1 ccv
1 ccv oring
1 bcm
1 valve cover gasket
1 fuel injector gasket
Theres a few other minor things..

Hate to tell you, but you need to talk to an attorney. Also-- stop driving it as much as possible (the lower the miles the better a postion you are in. I am at 20,000 miles on an 06-- basically screwed. If I had known that this thing was going to be abandoned by DC I would not have bought it either-- and I love it, besides the constant transmission problems.

You should have little to no problems getting the buy back. When I went in for the ball joint recall and to get the transmission fixed ("could not duplicate" of course) the dealer mentioned they already had to buy back several of them. Make them eat it if you are unhappy. I love the vehicle but the transmission recall that lowers the torque is going to piss me off to no end. I did not buy a vehicle with less torque-- I paid for the 295 foot pounds and I want it.

Well, I have 25k on it now, so I assume the dealer wont like that. But most of my problems didnt occur until after 20k miles. Also the dealer I bought it from just got bought out.
How much do attornys usually charge to take care of something like this?

I was speaking to my personal attorney within the first 6 mos of ownership as the Jeep honeymoon was already over. He told me a well documented history of multiple service visits (even unrelated issues) that become routine going back through the first year or so is enough to get Ohio courts to settle toward the buyer, even if Ohio's 12 month/18K mile statute has past. I showed him the stack of TSB's and my service records & dealer responses, he assured me this one would settle quickly if I wanted out.

Not sure of the limitations of the Lemon Law in Illinois, you may be past the statue of limitations for both time and mileage by now. Try a google search, was able to download Ohio's lemon law that way. My attorney is still itching to start mine but wants an hourly rate to proceed. Most attorneys won't take a Lemon Law case on a contingent fee basis but if the buyer wins in Ohio, the attorney fees are recovered. Mine wanted @ $200/hr to get things started.

I should add that there is a process in the owners manual. The attorney told me to ignore this, it's a diversion from your rights under the law. Most states have much tougher laws than DC will conceed in there arbitration process.
