Hello to my fellow Pennsylvanians

I have one for you.

My Step Daughter received a ticket over the weekend from the State Department of Revenue Generation (aka State Trooper). because she was driving my 05 CRD, and the office said it was not Emissions inspected. PA Law does not require Emissions, just Mechanical Inspection fpr all Diesels. I figured the Trooper doesn't know what he's talking about.

Following up - It seems my Registration DOES NOT STATE Diesel Emissions Exempt. Trying to get to the bottom of the foul up.

Anyone else from PA had a similar problem?

Would appreciate your input.

Thanks!

Odd. http://www.dmv.org/pa-pennsylvania/smog-check.php states "Emission Tests - The state requires a vehicle emission test once a year. So as to alert you when your time is up, the state will stamp on your vehicle's renewal notice the words "Emissions Inspection Required/Diesel Vehicles Exempt."" The brochure on http://www.drivecleanpa.state.pa.us/ (toward the top of the yellow box) clearly states that emissions inspection is limited to certain GASOLINE powered vehicles and then only if registered in certain counties. If you are registered in one of those counties the message referenced above should be on your renewal notice but if you are not registered in one of those counties and/or are not subject to inspection that notice won't appear.

If I was to guess you and your step daughter have run into the dreaded Jeep Liberty engines are all gas never diesel issue (a known problem for inspection stations in such states as AZ). I'd recommend calling the 1-800-265-0921 hot line and asking what's up and if you are not subject to emissions inspection how do they plan to fix the problem of the ticket at no cost to the collective you.

Glad I don't have to deal with this nonsense in Florida and that stoutdog is also registered here while at school.

I am In york PA. I was stopped once by our local police late one night. They had nothing to do because the bars must have been quiet that night. he said I didn't have that sticker and asked me what I did with it or why not? I told him this is a Diesel powered vehicle and by the state inspection code is exempt. He acted like he didn't believe me and had is citation/warning card book in hand. I showed him in the dash where the fuel gauge said "diesel only" pointed out the engine sound to him, then he started to get it. So said I will show you the fuel cap that says "diesel only" and you can look under the hood if you like. He said to me "you are correct have a good night and drive carefully."

If I were you I would take that fine to a near by police station or district justice that the fine is to get paid to with the Jeep and explain it too them and see what they say. if they don't void the ticket go to court and plead not guiltly cite the law and you should win.

I found this

http://www.ahs2.dep.state.pa.us/aq_apps ... s/test.htm

it says gasoline powered vehicles for my county

Another option is to go to the Trooper barricks and see if the commander will void the ticket before you make the court appearance.

That is about what I said... The commanding officer should be able to get that officer to void the ticket since you do no do any wrong. If anyone did it was that officer that wrote up a phoney baloney ticket. I would start calling and talking to people in that police station and if necessary the district justice office too.

the thing is I can't find anyplace so far online where it stated that Diesel powered is exempt. everything I have read says gasoline powered nothing about diesel or any alternative fuel car or small truck.

My reg. card says diesel exempt.

I found this
http://www.drivecleanpa.state.pa.us/changes/fs_sc.pdf

"Some exempt vehicles include vehicles registered as: antiques, classics, collectibles, street rods,
specially constructed, vehicles over 9,000 lbs., non-gasoline powered vehicles and vehicles
driven less than 5,000 miles during the previous year."

I'll let you PA folks chat on this but would note 1) "non-gasoline powered vehicles" and diesel is not gasoline; 2) the official brochure at the link I posted above is quite clear that the emission inspection requirment applies only to gasoline powered vehicles, which by definition excludes diesel, and then only in certain counties (yes there are specific vehicle exceptions mentioned but that would appear to translate as gasoline powered vehicle exceptions only); and 3) if you get the notice you are supposed to get if you are subject to the emission inspection requirement then that notice is supposed to state "...Diesel Vehicles Exempt". Seems pretty clear to me that the officer, to put it politely, screwed up.

Bottom line question appears to be only how to get the invalid ticket officially voided with the followup being getting the LEO's educated as to the difference between gas and diesel engines. Not to be flip but heh stupid open the fuel filler door and look for the nice green diesel only cap would be pretty simple.

Hello to all my PA Friends (and Non-PA too),

I'll keep all of you posted. Mikey1273 - I appreciate your input about your Registration. If your's says Diesel Vehicles Exempt on an '06, I have to figure since Chrysler started selling the Diesels mid year in '05, that the State never caught on. Thus, in '06 PennDOT might have figured it out, but never worked it back to '05.

I'm off to the Local State Police Barracks (Department of Revenue Generation) later this week to see what they have to say.

For the record - I live in a county that has emissions. This is what set off the Ticket on my Step Daughter. Even my '01 F-150 Ford Lightning says Diesel Vehicles Exempt on the Registration. I know darn well Ford has not built a Diesel F-150 in over 20 years.

Thanks all - I'll update later.

Scotty

'05 CRD - 170K+ miles and still going strong.
'01 F-150 Ford Lightning - Passes everything on the road but Gas Stations.
'11 VW Jetta TDI - It does say Diesel Vehicles Exempt .

No naturally aspirated in the bunch!

you are right. trooper has his hat on too tight!!
i am a pa emission mechanic.
all diesels have been exempt since day one.
there is currently no state approved equipment to test diesels.
i would call your local news stations to see if they would run a story on this ticket.
that story will have the troopers phone ringing, :-)r :-)r

Here's the Update,

Visited the Revenue Generators (State Police) today. The Inspecting Officer agrees that the Ticket should not have been written. BUT, PA Law does not allow them to just cancel it. Have to go to Court and fight it out. I would just pay it, but I've done nothing wrong and the principal of the matter tells me to fight it.

And the $ 110.50 fine is good incentive too. Just stinks you have to prepay it, then fight to get it back!

Mailed the Stub in today, requesting a hearing. At least the Officer was nice enough to tell me how to prepare and fight it.

Will update again, once I know the outcome.

That is a load of bull. Even if the law is that way its totally stupid that you have to pay it then fight to get it back when they admit the fine should never have been written up in the first place. Time to call News 8 in your side my friend.

he was nice and told you how to fight it oh wow, they broke the law by writing a ticket the law will not support. They should pay you intrest on your money and for your time to defend the ticket. I at least would not be happy until I know the office that wrote it was disiplined in some way. I have an idea, maybe he should pay the fine for you.

As noted, you need to present the appropriate documentation that confirms you are exempt to the judge. Be polite, precise and to the point. The case, since there is none, will be dismissed.

Went to Court today. We won, but.....

The Judge will allow the Officer to reissue a Ticket for the Taillights being out. We had received a warning, and fixed them already. Seems they do not want to let go of their Fine.

What a wonderful system.
