Since dino diesel comes from decayed plants isn't it also bio diesel?

In a broad sense yes, however biodiesel is specifically a fatty acid bonded to an alcohol. Also commonly known as methylesters. And the dino has been sequestered for millions of years, so burning it is adding to the CO2 levels in the atmosphere;calling it "bio" is a bit misleading.

Ah, but in the REPUBLIK of KALIFORNIA biodiesel can only be sold through licensed sellers and you must apply for a permit to buy biodiesel.

Plus if they ever make a stink about it we have bigger issues, like the fact my old man has been driving "my" CRD in socal while I live here.
(we decided that if we were going to have expensive registration for our vehicles that we would rather have it registered in Colorado)
