This morning I was at a stoplight minding my own business when...an 07 Tahoe hit me from behind  Keep in mind that I was STOPPED at a redlight. She climbs out of the Tahoe and says "sorry, I didn't see you". To make matters worse, my children were in the kj.

The Tahoe impacted the spare tire so there did not seem to be much damage. I then offer to have an inspection done before filing a claim on her insurance. The estimate comes back for 519 bucks. The lady tells me "go ahead and file because I don't have the 500 bucks". I know times are tough, but you own a 35,000 Tahoe and can't pay a 500 deductible? Yikes

Won't she have to pay the 500 dollar deductable anyway? One more question for the insurance guy...Could her inability/unwillingness to pay her deductable impact my repairs?

She might have Zero or $250 deductible. I used to have zero deductible on mine a long time ago. Until I had three windshields busted and two car stereos stolen. Insurane company said, uh, no more Zero.

Yeah, File a claim against the lady that hit you if the state you live in isn't a no-fault state like Michigan. (where filing a claim for an accident means your insurance rates go up as well)

Did that make sense?

Glad the kids are ok. Did you ask her if she had a cell phone up her rear?

But the big question is, what kinda of damage did it do to the 07 POS?

Her Tahoe seemed to be okay. There was a pretty serious scuff mark on her bumper from where she impacted my spare tire. I would bet dollars to doughnuts that she was on her phone at the moment of impact. In this part of Texas the cool thing to do is buy a HUGE suv and about a billion minutes for your cellphone  .

When you file against her insurance she isn't required to pay the deductable. She only pays her deductable when she does damage to her own car. Her insurance company will fix your KJ, you don't pay for anything. She will receive an increase in her rate when she renewals. Also, if your KJ is in the shop for longer than 24 hours demand to have a rental car.

On the flip side, if you live in a no-fault state and you file the claim YOUR rates will increase. (Gotta love a no fault state).

If you haven't filed I would to it today. As time passes she has the chance to get ahold of her insurance company and tell her side of the story. Guess what, the two sides hardly ever match.

Much better to always call the police first thing and then take pictures...even cell phone pics.

A reason why I always have my digital camera in my KJ wherever I go.

Being rear ended sucks...some idiot in a Toyota Camry (and it wasn't even a women!) hit me at a stoplight. They just hit my spare tire...slightly bent the metal where it is attached...but their hood was completely crinkled like tinfoil. I was so happy they had so much damage and mine was fine! It was my first accident and I had no idea what to do...nothing was filed for insurance as my car wasn't really damaged. (I didn't notice the metal...my bf did)

well she did admit fault by saying "sorry" thats one thing we were told never to say if involved in a tractor trailer accident. "sorry" means it was your fault
