Today so far Ive been playing phone tag between work with these Idiots. I called the selling dealer and the receptionist said that the sales manager is on vaccation again until the end of the week. just to be sure I had a relative call and ask for the same guy an hour later and it was the same story. Now as for the bill Ive been studying it and the service dealer lied to me and charged list price on all of the parts. I Googled all of the part numbers and the bill matches up with MSRP List prices on everything. As for the rocker and lifter set number 5069780AB they charged me $64.50 a piece $1032 for the whole set when I could have bought the whole set from ID parts for $359.95 exact same parts. :dizzy: they must think Iam stupid. Well one good thing about it I bought the Jeep outright and I didn't trade anything off for it, because if I would have had traded my truck in for it I would have went back to get it along time ago in fact I took it off of auto trader and I am keeping it. I left the service manager a message earlier today and they didn't return my call and I am doubtful that they will.

This is what I'd do, also considering geordi's advice: when the dealer gets back, go to him and offer to pay with a visa your part. He should cover the difference. Get your car from the jeep dealer (who fixed it). Then call visa to get your money back. Make sure the final bill is for the selling dealer, like jeep dealer should bill the selling dealer. Talk to the selling dealer into accepting the bill from the jeep dealer in his name, and just tell him it is easier for you to pay the selling dealer and not the jeep dealer. If the jeep dealer bills the selling dealer, your name stays out. This is good if you just reason with the selling dealer to pay your part to him directly since then you can invoke the warranty contract, this way you can prove visa you have a contract with the selling dealer when you will file to get your money back. If the jeep dealer bills you, since you have no warranty contract with him, it may be harder to get your money back.

It sounds to me like their "good relationship" means that one of them holds you down while the other one goes through your pockets. I strongly suspect that this is a scam they have repeated many times, and from a crooks point of view it is a pretty good one. Think about it: They conspire to rip you off on the warranty, the repair side makes you feel like you are actually catching a break while they fleece you, then the responsibility is spread over two different dealers, making it hard to hold either one of them responsible.

Again, what a crock of stinky poo! Sorry you are going through all of this. It is a darn shame that there are these dishonest dealers out there that ruin it for the honest ones. They are BOTH screwing you, and they did not even offer any lube. I do like the credit card idea, but at the same time I'd want the lawyer to do something as well. I am not buying that the guy is on vacation. Seems they are avoiding calls. May be time to pay a visit in person. I know when I had trouble with our old (no longer owned) Subaru(s) under warranty, they would scatter when I came in, and that was at a GOOD dealership that was helpful and took care of us. I can't imagine if they were a bad dealer. I'd be their worst nightmare, and I'll leave it at that.

Don't worry about whose name is on the invoice. The credit card lawyers won't care, so long as YOUR NAME is on the warranty contract.

You bought the warranty. The selling dealer told you to take it to the Jeep dealer for repair (a totally normal thing to do - they are the most likely to be able to repair the vehicle) and no matter who is actually doing the work, the warranty should pay for it.

I agree with ProfDip, there is a decent chance they are colluding on this, especially since most people would not be in the situation you are in: Having a spare car to use, and not having a note on the car they are jerking you around on.

Get your CRD back any way you can, at any cost - because you WILL get your money back. The repair dealer has very little incentive to pursue you after the chargeback refunds you, because that will cost THEM money in legal fees... And after you have a credit card judgement in your favor AND the warranty contract... You have a much stronger case. It is ALSO possible that if they did try to pursue you, that you could contact Visa again and inform them that they are trying to collect against Visa's favorable ruling... And Visa might go to bat for you yet again.

Just get your car back, that is the main thing they are using as leverage to continue to try and screw you. Let them screw someone else who is less informed.

Another option, that might be more fun and just as effective: Contact your local news station's "consumer advocacy team" or whatever it is called. The last thing that a bunch of roaches like these dealers will want... Is someone to turn on the lights on them. They might suddenly be VERY forthcoming with solutions (and I don't buy the 'vacation' horsepucky either) once a camera crew turns up and starts asking pointed questions.

Ok I finally got through to these idiots today well one of them that is. So it is true the service manager confirmed it the sales manager is on vaccation in Hawaii for 2 weeks now and is comming back Thursday and I plan on going down to Indy to try one last time to get this settled. Today I just squeezed the last dollar out of the service dealer, he came down $150 more because of the fuss I made about the parts at retail price and his serious lack of communication and poor handling of cooperation. I am now satisfied with the service dealer on this now, they want the deal done by the end of the month because the work order has been open for almost 2 months now since August 13th which is partially their fault anyway. Now its just between me and the origional sales dealer.

Dude I seriously cannot believe what I have been reading. You seriously have a signed and legitimate warranty contract and you are going to pay some money for this to be fixed? You have got to be kidding me? Grow a pair of balls and tell the dealer you bought the jeep from your not paying a penny.

Its almost over now guys, I went to see my lawyer again today one last time and he said go ahead and settle bacause being that its in Marion County it could be a long and expensive process with no guarantee of success to file litigations and would take months to get my vehicle back so he said that for a few hundred dollars its not worth it and this way I can get my vehicle back right away and not have it sitting out in the weather until who knows when.

This is a bunch of B.S that no one should have to go through. The lesson learned here is that used car dealers are mostly crooks they pay wholesale prices for trade ins and try to sell for above retail price and the 30 warranty useually isn't worth anymore than the paper that its written on. I was literally screwed into this situation through a combination of the sales dealer and the service dealer because lets face it if the vehicle would have not been under any warranty at all I sure wouldn't have ever taken it to a dealer for repair 105 miles away. I done a timing belt change on my 02 Volkswagen Jetta TDI and I just replaced the starter on it this week so I do have a fair amount of mechanical ability of my own and Iam sure I could have learned how to do the rockers on my own as well. I also wouldn't have had a $1,196 parts bill because I would have ordered from ID parts instead of paying stealership prices.

So........ are you going to fight it with the credit card as previously suggested? I think that is a good idea... You'd be foolish not to do that. I, myself, would not stand for this. The lawyer was not too interested in getting this resolved for you, though he did offer advice. Nobody, and I mean NOBODY should get bent over like this when it is clear as day that it has a warranty, which covers the said issue. I would have taken the vehicle back and asked for my money back if they tried to screw me. Let them eat it. Hope you had lots of lube, sounds like you needed it unfortunately. Seriously though, I would do as geordi suggested...

You need to make it their problem, obviously the lawyer didn't see 6 figure recovery possible, so while he would give you the advice... It was advice to go away as quietly and quickly as possible. He doesn't care about anything other than his time-to-money ratio, but that isn't surprising for a lawyer.

What is different about you, is that YOU have a personal stake in this. Get your car back, and then make it their problem. Charge it back. The worst that happens, is that they take the provisional credit money back from you. You will be right back in the same place you are now - out a bucket of cash.

Do I think this will happen? No. Visa WILL fight for you. The contract for the warranty is strong proof that YOU should not have to pay for this repair. Their bad faith in farting around for so long also is another mark against them. The burden of proof is on THEM, and Visa will make them suffer to cross that threshold.

Iam going to try the credit card thing however I am doubtful that they will accept a credit card from me especially now since that the service dealer keeps telling me he needs a check to clear the back or cash, certified check the day that I come to pick up the vehicle. We have been on bad terms now for the 2 weeks that the sales manager had been on his big Hawiian vaccation and now that he's back little progress had been made and I just keep getting more pissed off all the time because their holding up my vehicle and the service manager keeps talking about putting a lein on the title if the bill isn't paid in full. Now as of Friday afternoon he's telling me that he needs to close the deal by the end of this month so I said " I can't afford to pay it your going to have to come down more if you expect me to pay especially by the end of the month, come on man lets just make amends and get this over with were only $250 short." He then said "I will come down $150 more" and he wasn"t happy and proceeded "if it isn't paid by monday night though it goes back upto $900 on your part". I then called the sales dealer warranty manager right away that just got back from vaccation and asked for more money and told him that I was short on money and I couldn't afford to get my vehicle back and he said "do you always do business this way" and I said "no do you." He then said "I am going to send you a check for $100 to help you out and that's it because I already paid $1,000 to Tom O'briens on the bill but we need to get this over with and put it behind us." So now the gap is smaller than it has ever been and I feel its time to just settle on it after all atleast Iam getting some lube.

Tell them you can only pay with credit card or you don't have cash that you can use in your checking, I bet they won't object.

Jeez. The service manager insisting on a certified check or a CLEARED check or cash... HE KNOWS HE IS SCREWING YOU and wants to try and prevent a clawback because HE KNOWS HE WILL LOSE. Check / certified / cash are all the same as cash: The burden is once again shifted onto you.

Putting a mechanics lien on the car is a threat, but probably an empty one - It will involve the court system again, and you then have the right to contest it IN COURT and the filing fees are on him. Again, the warranty document is your shield in this, and then it is FREE for you to fight it - AND you have your car back.

I understand getting hot and grumpy with them, but perhaps this would be a good time to go in with a friend (or send a friend in to the cashier instead) and just quietly state to the cashier that you want to settle the bill. Play dumb and only hand in the credit card, but above all, try to be calm. I realize it sucks, but it would have been better to pull the pin on the credit grenade weeks ago. The total would have been higher, but getting pissed at the service manager only hardened his position. Paying a higher amount to get your car back would have removed their ability to hold the car against you, and charging it back then would have made it THEIR problem instead of yours. Getting frustrated with them only made this harder, but your legal rights are STILL being stomped on.

Think about the Mafia from The Godfather: Is not personal, is business. What you want to do is deal with the underlings now, NOT the service manager that is pushing for a cash payment. The chances are, the cashier doesn't know you at all, and the service manager would most likely not have put any payment instructions / demands in writing on the repair report. If it is in writing, GET A COPY. That can be even more ammunition for you when (if) you decide to go over HIS head and involve the owner of the dealership or the local media. Anything that isn't in writing, has no legal weight. On that note - you might want to have a small recorder running in your pocket. It is only illegal in criminal cases, this isn't. If he shows up to the cashier's desk and starts throwing his weight around, you can simply state "This is how I have the ability to pay. If this is so important for you to close out, take it or leave it. Your signs say you accept credit cards, it doesn't say 'only when we agree' will you accept this form of payment."

One thing that I fail to understand is if they are not pulling a fast one you why they are insisting on cash/cheque payment and avoiding a credit card. if you were to buy a car credit card deposit/ payment is acceptable so is the payment for OC.
So you just need to come up with a better story that you are strapped for cash and only way to pay is CC.
Then take it up with CC if I were in your shoes I would take these monkeys to court and represent myself as the only chance they have of winning this is with a kangaroo court any Judge with half a brain will settle in your favour.
Your lawyer doesn't want to peruse this as there is on enough juice in it for him so is giving u a lame excuse to settle.
All things said legally you are on sound footing on any logical judicial system.
Good luck.

ok so this is a nightmare come true, Monday I sealed the deal and made the payment and everyone felt like they got screwed over including me. Just today I went down to Indianapolis with the trailer to get it. I loaded it up and brought it home it was a 2 hour drive each way. As soon as I got it home I unloaded it and drove it around the country side for about 5-10 miles at 60-70 mph and the check engine light came on right away after just 10 minutes. I stopped and took off moderately, and it has a slight hesitation at first and then runs out good at highway speeds. Iam getting ready to hook up the code reader here in alittle while to see whats going on but Iam sure its going to be P0101 again Iam almost sure of it. If so it has to be a sticking valve or weak valve spring mabe its all being caused from carbon buildup on the valves from that darn ERG I just don't know yet for sure.

This is totally phucked up. So did you pay with a CC? If there are new issues now, I'd be taking it to court. Piss on both dealers. I, personally, would be so angry, I would spend the time and effort making sure this made it to court just as a matter of principal. These dealerships makes a bad name for the good ones out there. Keep us posted... I am mad just reading and thinking about your situation!
